Terms of Service — Nothing Serious

1. Acceptance of terms

By accessing or using Nothing Serious (the 'Platform'), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these terms, you must not access or use the Platform.

Access to the Platform is granted solely at the operator's discretion. These terms constitute a binding agreement between you ('User') and the Platform operator ('Operator') governing your use of the Platform and all services provided through it.

2. Description of the Platform

Nothing Serious is an AI-powered personal automation platform that orchestrates everyday operations through intelligent agents. The Platform integrates with third-party services — including email, messaging, calendar, financial, and cloud infrastructure providers — to execute automated workflows, produce analytical summaries, manage tasks, and coordinate information on behalf of its users.

The Platform employs large language models and other artificial intelligence technologies to process, classify, summarise, and act upon user data. AI-generated outputs are intended to assist human decision-making and do not constitute professional advice of any kind.

3. Access and eligibility

The Platform is a private, invitation-only service. Access is not available through public registration and is granted exclusively at the Operator's discretion. The Operator reserves the right to grant, suspend, restrict, or revoke access to any user at any time, for any reason or no reason, without prior notice or obligation to explain.

Users are responsible for maintaining the confidentiality of their access credentials. Any activity conducted through an authenticated session is deemed to have been authorised by the account holder.

4. Acceptable use

Users agree to use the Platform only for its intended purpose as a personal automation and operations tool. The following activities are expressly prohibited:

Sharing access credentials with any unauthorised party or attempting to grant access to individuals not approved by the Operator.
Using the Platform for any unlawful, fraudulent, or malicious purpose, or in any manner that violates applicable laws or regulations.
Attempting to reverse-engineer, decompile, disassemble, or otherwise derive the source code, architecture, or proprietary methods of the Platform.
Interfering with or disrupting the integrity or performance of the Platform, its infrastructure, or connected third-party services.
Automated access to the Platform (including scraping, crawling, or programmatic interaction) without the Operator's prior written consent.
Using the Platform to store, transmit, or process content that infringes upon the intellectual property rights of any third party.

5. Third-party services and integrations

The Platform connects to and exchanges data with third-party services as part of its core functionality. Users acknowledge that their use of such integrations is also subject to the respective terms of service and privacy policies of those third-party providers. The Operator is not responsible for the availability, accuracy, or conduct of any third-party service.

Users are responsible for ensuring that their use of the Platform in conjunction with third-party services complies with the terms governing those services. The Operator does not warrant that any third-party integration will remain available or function without interruption.

6. AI-generated content and limitations

The Platform uses artificial intelligence to generate summaries, classifications, recommendations, and automated actions. Users acknowledge and agree that:

AI-generated outputs are probabilistic in nature and may contain errors, omissions, or inaccuracies.
The Platform is designed to augment human judgement, not to replace it. Users retain full responsibility for reviewing and acting upon AI-generated outputs.
The Operator makes no representations or warranties regarding the accuracy, completeness, or fitness for purpose of any AI-generated content.
Automated actions performed by the Platform's agents are executed based on user configuration and may have unintended consequences if misconfigured.

7. Intellectual property

All intellectual property rights in the Platform — including its software, design, architecture, documentation, and proprietary methodologies — remain the exclusive property of the Operator. Nothing in these terms grants the User any right, title, or interest in the Platform beyond the limited right to use it as an authorised user.

Content created by users within the Platform (errands, notes, configurations) remains the property of the user. The Operator claims no ownership over user-generated content but retains the right to process it as necessary to provide the Platform's services.

8. Availability and service levels

The Platform is provided on an 'as-is' and 'as-available' basis. The Operator makes no guarantees regarding uptime, availability, response time, or uninterrupted service. The Platform may be modified, updated, suspended, or discontinued at any time, with or without notice.

Scheduled and unscheduled maintenance, infrastructure changes, upstream provider outages, and feature modifications may result in temporary or permanent disruptions to service. The Operator will make reasonable efforts to minimise disruption but assumes no obligation to do so.

9. Limitation of liability

To the maximum extent permitted by applicable law, the Operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to the use of the Platform, including but not limited to:

Loss of data, revenue, profits, or business opportunities.
Service interruptions, delays, or failures.
Errors or inaccuracies in AI-generated outputs or automated actions.
Unauthorised access resulting from compromised credentials.
Actions taken by or failures of third-party services integrated with the Platform.
Any damages arising from the User's reliance on the Platform for time-sensitive or critical operations.

The Operator's total aggregate liability for any claims arising under these terms shall not exceed the amount paid by the User for access to the Platform in the twelve months preceding the claim, or zero if no fees were charged.

10. Indemnification

Users agree to indemnify, defend, and hold harmless the Operator from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to the User's use of the Platform, violation of these terms, or infringement of any third party's rights.

11. Termination

The Operator may terminate or suspend a User's access to the Platform at any time, for any reason, without prior notice. Upon termination, the User's right to access the Platform ceases immediately. Provisions of these terms that by their nature should survive termination — including limitations of liability, indemnification, and intellectual property — shall remain in effect.

12. Modifications to these terms

The Operator reserves the right to modify these Terms of Service at any time. Changes will be reflected by an updated effective date at the top of this page. Continued use of the Platform following any modification constitutes acceptance of the revised terms. Users are encouraged to review these terms periodically.

13. Governing law

These terms shall be governed by and construed in accordance with applicable law, without regard to conflict of law principles. Any disputes arising from these terms or the use of the Platform shall be resolved through good-faith negotiation between the parties.

14. Severability

If any provision of these terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
